    So I now find out Costa Coffee say ... If I had given them my Vehicle Reg when I came in, the fine would have been squashed.

    Parking Eye asked for my receipt to say I was using Costa coffee Facility ...... Who keeps Lunch time receipts.

    The permitted time of 3 hrs became 2 hrs then had been change overnight to 90 minutes.  These people running Parking Eye are Ex Clamper Companies with posh Lawyer's plugging loop holes to extract blood money from easy target Motorists.

    So what should I do ....... pay up .... £80 if paid within 28 days and save £20 on £100 fine.  or dig in ... call their ... bluff.  ?  What would you do.  !!    BEVIS

    They have the "LAW" on their side .......... I have no receipt like Bevis ..... he lost but as far as I know has still not paid fine.?

    You don't see friends for ages then you see them twice in a week.  Told them about getting Parking ticket at Costa Coffee and they said they got one to.!   "I said," I wasn't going to pay let them take me to Court.!  "They said," they had paid the fine.?   What ! ..... Why........ They said they couldn't be bothered with the hassle it was easier just to settle by paying the £80 ..... if it went to Court could end up costing hundreds of pounds.  They had no receipts as I paid for Lunch and they had not bought anything Shopping so had no prof they used the facility.  I don't have my Costa Coffee receipt but found my purchase receipt from "Wickes" so sent that to say I was using the facility and a genuine customer.  Waiting for reply !

      Conflicting Stories regard best way to avoid Parking Ticket having just got one.?    Some who go to Court win,  others lose.!   Parking Eye quote the Bevis case win..... to intimidate people to just pay up like my friends did.  I called into Costa Coffee today and asked why there was no sign to inform customers they should give their car registration to avoid the overstay Parking Ticket.  "They said," as the Land Owner own's the property and they just Lease it they have to ask permission to post signs and they were told to register car numbers only if asked. ?
      So ! how am I supposed to know if there are no signs to tell me. !  You will have to ask Parking Eye.!
      I can only assume Parking Eye give the Land Owner percentage of the revenue they collect thus making it profitable to not place signs or put them where they have to be pointed out before you see them, then change them from 3 hrs to 2hrs then 90 min without notice.
    Smack,s of entrapment to me so I will be fighting this one all the way.

    So taking an overview, the landowner would prefer thriving buisnesses. The customer drives to the often out of town store, spending money on fuel, not to mention,insurance , tax, upkeep of vehicle and then pays to park.When overstaying your time, youve breached your contract and get asked to pay a charge of normally between £80_100. And you are supposed to get excited by the 2 for 1 offers on packs of biscuits. The only Great in Britain is the Great RIP OFF. Next recession, there be free parking.lol lol lol fkg lol lol lol.

    You hit the nail on the head.......... and will be my argument should we go to Court.!  "Parking Eye say," When I entered the Land Owner's land ( Shopping Complex ) I agreed to the terms & conditions of use.!  By overstaying I breached that contract and therefore liable to the fine. ?

    So Parking Eye are not interested, if I was Shopper or user of the Complex and their latest letter tell's me " If I do not pay the Fine they will start Court proceedings and say... The Courts have found in their favour ( Bevis case ) I will be Liable to their Legal Fee's and expenses.!

    Well ..... bring it on !    I play Poker and know a BLUFF when I read it.?

    Spiders are like Squatters they refuse to move.   Each day the web get's smaller less intricate. 

    Should I send in the ......... Bailiffs ..... or Animal Rescue. !   Tried getting it out to catch it and move somewhere else but it wont budge.  I like Spiders so don't want to kill it.   Hides in the day .... at night comes out to play.

    Tried squirting water in the mirror to flush it out ....... must have seat belt or life jacket on. ?

    Hi Trish, I hope you are well Annie sends hugs,  she is still looking after her sister who has Parkinson's,  she has become her full time carer now, so has no time to play poker any more. 
    I keep telling her to take a break but she wont leave her sister on her own.  Head strong wife to deal with who's not getting any younger and finding being a carer hard work.  I try to help but men tending to ladies personal requirements is embarrassing so leave it to her to sort out.  I look after the home I now have a "Hoover Licence" and know every washing cycle eco/  never forget to put the Comfort in. I'm living on beans on toast ( I kid u not ) + few beers.!   I miss her to,

    Meals on Wheels came round today just in time to stop me fading away.  Got couple of hugs and she was gone.!

    I joked she's left me for another woman and I'm a bachelor again. ?  that fell flat .......  got no pudding.!

    Well,  "Parking Eye" being the bully boys they are,  want to take me to Court and sent me Court Papers asking for my Defence ........They show my car entering and leaving car park stating over stay.  Filled them in and returned them to them ..... also the Court. .......  Let's see if they will produce their contract with the "Land Owner" for the Court to read regard levy fines for genuine customers.  Sure that's not what the Land Owner agreed given he leases to Shops that need Customers.  Not frightening me,  polished my shoes and pressed my tie ready to go.!

     Hi,   Chill    Citizens Advice not like they used to be! worse that A&E ..... deal mainly with people that can't speak English & housing problems. Googled it and losing the will to live given the information.  Think it will be hit & miss if I go to Court, so putting my faith in Justice over bullying.   Just noticed Parking Eye trading under new name / several new names, must be trying to ditch bad publicity they got from Bevis v Parking Eye case.  Court date is set for next week they sent me papers today that needed to be in Court by today so can't post them had to fill them in quickly get a cab and hand them in personally.   How sneaky is that to make me miss time limit for defence.   Made me more determined now not to let them away with it. They want my £80 they will have to earn it as I'm not giving it to them without a fight.    Every Dog has it's day.?     Woof

    Letter arrived from "Parking Eye"  Typical last minute again.


     "Further to your dispute regarding the above Contractual Parking Charge Notice."  we would like to confirm that this has been waived as gesture of good will.  Court Proceeding (cancelled) no further action is required by you. 


    Mixed emotions! was looking forward to my day in Court and angry my friends paid their blood money.

    Hi Chill,   My case was that Parking Eye was in breach of their contract with the Land Owner.  Costa Coffee had no signs to inform customer that they needed to give their reg to avoid fine for overstay while dinning there.

    If you give Costa your reg you can stay as long as you like.   

    Best was I phoned Court to check the proceeding had been cancelled and they said they had no record of the case and only papers were what I handed in last week.    Trying to calm down ..... want to take them to Court for Harassment.

    Very, very interesting this. I would explore a few avenues here, and get some advice.. If what you say is true, there could be folk out there due compensation, or reimbursment. If youve got it in you, take the matter further. Local rag is a good start.Again , take advice.   A nice pair of shiny shoes and nowhere to go .Get someone in and take the missus out.glgl.

    They would say they were within their rights to fine me and acted compassionately by waiving the fine.  Already checked and no gain in perusing this.!
